General terms and conditions
1. Conclusion of contract
The rental contract is concluded exclusively between the booking customer and Jäger Immobilien GmbH (in short: SKIKÖNIG, SCHIKÖNIG). The rental of all rental equipment requires the approval of our general terms and conditions (GTC). The rental takes place exclusively according to the following conditions.
The rental costs are determined by the category chosen by the customer (diamond, platinum, gold, silver, bronze), as well as the chosen period of rental according to our rates for rental, which can be found on our homepage or on site in the shop. Our prices are inclusive of all taxes, at the rate in force at the time of rental.
The booked rental equipment can only be booked for consecutive days. The booking can be upgraded at any time for an additional charge.
Payment can be made in cash, with Maestro debit card or by credit card (VISA, MASTERCARD). The online booking can be paid by credit card (VISA, MASTERCARD) or by Klarna (bank transfer).
In the event of a later subsequent booking or refund, SKIKÖNIG is entitled, in consultation with the customer, to debit or credit the corresponding amounts to the customer's account. Any fees incurred shall be borne exclusively by the customer.
Vouchers and special offers are not valid in combination with other promotions. No cash redemption. Only one voucher can be redeemed per purchase, per person.
In case of late payment, 6% interest on arrears will be agreed.
4. Changes/terms of withdrawal/cancellation
Up to 3 days before picking up the sports equipment, the customer can have the booking changed in terms of time and content at no extra charge. This change must be notified to SKIKÖNIG in writing at email@example.com in time.
According to § 18 FAGG Ausnahmen vom Rücktrittsrecht Abs. 1 Z. 10 „Dienstleistungen, die im Zusammenhang mit Freizeitbetätigungen erbracht werden“ there is no right of withdrawal.
A free cancellation of the booking is only possible due to illness, accident or other serious reasons. If the reason for cancellation is an illness or similar, SKIKÖNIG must be notified immediately in writing to firstname.lastname@example.org by means of medical confirmation. If there is no case of illness and no cancellation package has been booked, no cancellation and therefore no refund is possible.
Bad weather conditions or other hindrances, which are not within the control of SKIKÖNIG, do not entitle the customer to cancel the booking free of charge.
In case of illness or injury of the tenant during the rental period, the following regulation applies upon presentation of a medical certificate:
- In case of immediate return of the rental equipment: no rental fee will be charged from the date of issue of the medical certificate.
- Credit note or money return from the date of issue of the medical confirmation for the remaining rental days already paid.
If a medical certificate is not presented in the event of injury or illness, the full amount will be charged.
5. Pick up and return of equipment
The customer has to present an official photo ID (e.g. passport or driving licence) as well as his (printed) booking confirmation in the rental shop and agrees that a copy of these documents will be made. In the event of queries/requests by the rental shop for official photo IDs of children and young people, which prove the age indicated, this must be presented.
The pick up of the sports equipment is usually possible on the day before the first rental day from 14:00.
Rentals after 14:00 are only charged from the following calendar day.
The sports equipment must be returned on the last day of the agreed rental period before closing time, or on the following day before 10:00 am. If the rental item is returned before 10:00 a.m., the current calendar day will not be charged. In the event of longer use, the difference between the actually used rental period and the reserved or paid rental period will be charged at the usual rental conditions and is payable directly on site. If the rented sports equipment is not returned in due time without good reason, the customer must expect theft to be reported to him and a corresponding surcharge to be levied.
The rented sports equipment must be returned in a suitable condition. Place of performance is the location of the rental shop where the sports equipment was rented. The rental equipment shall only be deemed to have been duly returned if it is returned personally to the rental shop during the respective opening hours.
The passing on of the rental equipment to third parties is prohibited.
The customer is fully responsible for the rented sports equipment and must only use it carefully in accordance with its function and conditions of use. If the sports equipment already has defects at the time of rental, the rental shop may - if it cannot remedy the defect - replace the sports equipment or withdraw from the contract.
The customer must ensure that the sports equipment is stored in such a way as to prevent confusion or theft. The rented sports equipment is not insured, unless insurance is taken out.
In case of theft, a police report is mandatory. The following deductibles shall apply immediately:
- Diamond rental package EUR 500
- Platinum rental package EUR 400
- Gold rental package EUR 300
- Silver rental package EUR 200
- Bronze rental package EUR 100
- shoes rental package EUR 80
- poles rental package EUR 30
If the loss, damage or theft is caused intentionally or through gross negligence, if the terms of this contract are not complied with, if the insurance package is not booked, you will bear all associated costs. Examples of gross negligence: "The equipment is left unattended outside after 8 p.m. and is stolen. " or "The skis, the snowboard will be used on the sidewalk, parking lot or on the road and the surface will be heavily scratched."
For all other articles the current value is to be replaced! The deductible only applies if a police report is submitted, otherwise the current value is to be replaced.
In the event of breakage or damage due to improper use or theft as a result of contraventions of the storage obligations imposed, the customer shall be liable for the repair costs or the current value. In case of wilful damage, the repair costs will be charged.
We assume no liability for accidents of any kind.
In principle, the rental price does not include insurance. However, you can insure the items rented from SKIKÖNIG. The insurance packages are priced as follows:
"Basic" adults: EUR 10, children & teenager up to 16 years, EUR 5.
"Complete" adults: EUR 20, children & teenager up to 16 years, EUR 10.
In the event of theft or damage, the insured person must claim the following benefits based on the insurance package booked:
Basic" insurance package: 20% of the deductible on the booked package.
Complete" insurance package: Full coverage. No deductible.
8. Insurance conditions
a) In the event of theft of a loaned device, the police inspector responsible for the place in which the theft happened, must be notified immediately and the theft must be reported immediately to the SKIKÖNIG.
b) The insurance policy only applies if the local police station reports the theft.
c) The insurance only becomes effective after full payment of the insurance fee!
d) The insurance is valid throughout the booked rental period and includes all rental items of the insured person by SKIKÖNIG.
e) The insurance is personal and cannot be passed on to third parties!
f) Thefts from fixed rooms (ski cellar) and at après-ski bars are not covered by the insurance.
9. personal data
SKIKÖNIG processes the customer's personal data for a specific purpose and in accordance with the legal regulations. The personal data provided for the purpose of leasing will be used for the fulfilment and execution of the contract. These data are treated confidentially by us and are not passed on to third parties who are not involved in the ordering, delivery and payment process.
10. place of jurisdiction
For all disputes arising from these contracts, Austrian law shall apply exclusively and the District Court of Landeck/Tyrol shall have exclusive jurisdiction.
